Terms of Service

1. Agreement to Terms

By accessing or using the Septenar platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

The Service is operated by Septenar Inc. ("Septenar", "we", "us", or "our"), a Canadian corporation.

2. Definitions

  • Account Owner: The individual or entity who creates an account and is responsible for billing and compliance.
  • Builder: Any user with access to create and manage forms within the platform.
  • Participant: An individual who responds to forms created through the Service.
  • App: A deployment context (website or application) where forms are embedded.
  • Form: A survey or poll created through the Service.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials, including passkeys and recovery codes.

You must be at least 18 years of age to create an account. If you are creating an account on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. Acceptable Use

You agree not to use the Service to:

  • Collect personal information without appropriate consent
  • Violate any applicable law, regulation, or third-party rights
  • Distribute malware or engage in phishing
  • Circumvent any access controls or rate limits
  • Resell or redistribute the Service without authorization

5. Data Processing

As an Account Owner, you are the "organization" under PIPEDA responsible for the personal information collected through your forms. Septenar acts as your service provider and processes data according to our Data Processing Agreement (DPA).

You acknowledge and agree that:

  • You are responsible for obtaining valid consent from participants
  • You must provide participants with access to their personal information upon request
  • You must comply with all applicable privacy laws in the jurisdictions where your participants reside

6. Billing and Payment

Usage of the Service is subject to the pricing and billing terms applicable to your account tier. Details are available on our pricing page and in your account dashboard.

Additional usage beyond your tier's included credits will be billed at the published rate. You agree to pay all applicable fees in a timely manner.

7. Intellectual Property

The Service, including its design, features, and documentation, is owned by Septenar and protected by intellectual property laws. You retain ownership of all content you create and data you collect through the Service.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications to the Service with reasonable notice when possible.

9. Limitation of Liability

To the maximum extent permitted by law, Septenar shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

10. Termination

Either party may terminate this agreement at any time. Upon termination, you may export your data within 30 days. After this period, your data will be deleted as described in Section 7 of the Data Processing Agreement.

11. Governing Law

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.

12. Changes to Terms

We may update these Terms from time to time. Material changes will require your re-acceptance before continued use of the Service. We will notify you of changes via email and in-platform notification.
